    ‘I have received Notice of Intended Prosecution – what should I do?’

    Receiving a Notice of Intended Prosecution (NIP) for speeding does not automatically mean you will be convicted.

    If you are happy to accept a fixed penalty, or attend a speed awareness course, then instructing a solicitor is unlikely to be necessary. However, if you are at risk of a ban and/or potentially facing the prospect of totting up to 12-points, then we would strongly recommend that you instruct an expert solicitor to have conduct of your case. 

    You are not obliged to accept a fixed penalty offer, however you would likely risk a greater financial penalty if you chose to reject or ignore the offer.  It is best to give us a call if you are unsure how to deal with a fixed penalty offer.

    Defences to the offence include challenging the accuracy of the speed detection equipment as well as looking into whether the police have properly complied with the relevant timescales in sending the Notice of Intended Prosecution.

    The Court will always be asked to consider your mitigation prior to sentence. The most common grounds are that your licence is crucial to you earning a living, however all cases are different. We will need to discuss the importance of your licence with you over the phone or at our office so you can decide the best way to proceed.

    No, most minor speeding offences are either dealt with via the acceptance of fixed penalty offers or before private Court hearings, heard via the Single Justice Procedure.

    Completing the course will prevent the imposition of points on your driving licence, if it is important for you to have a clean licence, it would always be advisable to complete the course if the opportunity is available. 

    Yes, but a new driver’s licence will be revoked if they accumulate 6-points or more for offences committed within two years of them passing their driving test.
